  1. Actually - I'm not. It's foolish to think that someone who owns and operates the 2nd largest fan fiction website on the internet would be ignorant of copyright laws. Not only have I had discussions with various legal sources, I did my own research prior to consulting with them. Your arguments hold no water. Please also note, that as you are intent on infringing on EL James' copyright, your information including IP address data has been sent to both her and her editor along with copies of what was posted to this site and our removal of it. I wish you luck with your faulty arguments if and when they decide to send you a C&D letter I'd say happy writing, but it is apparent that you much prefer taking someone elses work in it's entirety as opposed to creating something of your own.

  2. I feel like it’s September of 2002 all over again! Almost 10 years ago to the date, FanFiction.net cleansed the site of all ‘adult’ content – Which is why AdultFanFiction.net exists in it’s current form. Today they announced that for the first time in years they are actually going to enforce their no adult content (or in their terms MA content) again. Now, for those of us that enjoy places that enforce their Terms of Service, we are rejoicing that they are finally acting like a responsible site! We’ve seen an uptick in registrations and I would like to take a moment to welcome all of our new members! We've had one of our biggest days for registrations in a long time, 250+ and counting today alone! That being said, AdultFanFiction is not FanFiction, nor are we associated in any way shape or form with them. We are two completely separate websites and are not affiliated with them in the least. A couple things that new users migrating should be aware of: We are an adults only site. This means you must be 18 to use it. Yes, we do verify your age, so please, if you've signed up and are underage, let us know now to avoid getting in trouble. I do this not to be mean or nasty, but because I really don't like the thought of jail time. I look horrid in orange, I swear! Please respect this policy We actively moderate the site and enforce our Terms of Service and Content Guidelines. Please read them carefully to ensure that you are not in violation. All new uploads are reviewed on a weekly basis. You may receive an email or a review asking you to fix something. Again, this is not because we enjoy being mean, but because we have our ToS in place for a reason. We are in the middle of a code re-write. This means that certain sections have different layouts and not all features are currently active. Please bear with us through out the reconstruction - I swear it will be better once it's done! To add on to number 3, we haven't sold our soul to the advertising devils, so I promise you won't see those horrid little pop ups that FF.net uses, but that means that we have very little incoming revenue and most of it goes to pay our monthly hosting cost. As a result, we are running (with the exception of the new code) code that is for the most part 5-9 years out of date, which means that a number of the features you may be accustomed to at FF.Net aren't here. You may see them with the new code, but please be patient, there's about another 6 months in this re-write to go. Remember I mentioned that we have little incoming revenue a moment ago? Yes, we make some off our advertisers, but again, mostly pays hosting costs - Your donations if you like the site are very much appreciated and are always used to improve the site! You can learn how to donate here Forums - Our forums are separate from the archive. They are two different programs. This means that if you would like to participate in both, then you do have to register separately for both. We'd love to see you on the forums, so feel free to hop on over! I do recommend looking over the previous news posts for a variety of important information, but you can also do all kinds of fun stuff, from story searches to various games, read the FAQ's to help learn how our Archive is set up or just chat away in our Shoutbox! (Please note, normally the Shoutbox is reserved for Forum Members only, but for the next week or so until registrations start to level off, it will be open to guests in need of assistance) Oh and one last item for Lucky Number 7? Myself and my staff are friendly, so if you have a question please don't be afraid to ask! How to contact us can be found here. So again, welcome to AFF.Net - So long as you follow the rules, I think we're gonna have a rocking good time together! After all, that's what this place was created for to begin with! Let the smut roll!

  3. As per the offical website: http://www.copyright...17/92appii.html Broken down to easy to understand terms: http://www.templeton.../copymyths.html Heaven forbid the expedient application of our ToS and copyright law be consider tyrannical - Let's go after the gov't - How dare they create copyright law! It's tyrannical I tell you!!

  4. Copyright is implied and automatically granted even if not implicitly stated to any work from April 1, 1989 forward, please re-read your copyright law. Again, you are incorrect.

  5. Okay deary - First off, DG is my right hand woman; it is a cold day in hell when her and I aren't on the same page, but you can't get any higher than me - I own the site. Since your ignorance of copyright law is amazing, let us have a little lesson: Fan Fiction is considered to be a transformative or derivative work which by the US Copyright Act defines as: 17 U.S.C. § 103(b) states: They further more defined it further in a later publication (US Copyright Office Circular 14: Derivative Works) Therefore, a legal case can be made that fan fiction can be copyrighted so long as there is a large amount of new material. To apply it to this particular instance, EL James used only the character's names and descriptions, creating her own characterizations, settings, plot and world, which can be regarded as a substantial amount of new material. While to date, there has been no formal testing of this in court to the very end, Salinger v. Colting is an excellent example. While there was initially an injunction from the District Court, the Appellate court reversed the injunction and sent it back down for the 'fair use' and transformative work doctrine to be reapplied. Unfortunately for those of us waiting to see how this would ultimately be determined, the parties settled out of court and it was never fully tested in a court of law. That being said, Master of the Universe is not public domain and you may not post it (or the same story with names changed) on AFF. The story was a product of her imagination that while she changed names to create a original work, is hers in its entirety - Both versions. We have removed your posting of the story from our site and it may not be republished.

  6. Master of the Universe was published by EL James as a fanfiction. It's still HER original work. You cannot post that here. You cannot attempt to pose as another, as you're obviously doing. Because it started life as fanfiction does not make it automatically public domain.

  7. Indeed. Main reason I stopped reviewing!

  8. There seems to be a misunderstanding among many of you. Thinking that ONLY adult content is wanted here. That is not the case at all. Fiction of all "ratings", with or without adult content are welcome here. While the archive certainly has a great deal of adult content, the ADULT in the site name is geared towards the fact that users are to be 18 or older, and that this is a group of ADULTS who come here to write, interact with each other, and etc. A suggestion for you authors, should your stories be "fluffy", contain no NC-17 type stuff, or whatever, you should make a note of it, so the readers who are looking at your summaries understand that. With the current reworking of the archive, I will suggest that some additional tags be added for this kind of story. Finally, if you, the author, are FLAMED because someone thinks you must have adult content, because you are on this site, please DO report it.

  9. Why- Disclaimers are needed to not only protect the archive itself, but the user, individually. By disclaiming stories, the archive is protected to the point of worst case scenario being deletion of content, and the user is protected whereby the archive is better able to protect the user's information on file, particularly the emails. What is needed- For fanfiction- Say that you do not own the fandom, by NAME of that fandom. Character disclaimers are not enough. Say you make no money on the fiction. Example Crossover fanfiction- ALL fandoms in the story must be disclaimed. If the user knows they're going to exceed the 240 character limit in the disclaimer field, then put in that field “see full disclaimer below”, and do the FULL disclaimer as required. It only needs to appear in the first chapter, if disclaiming in this manner. Celebrity/Real person fiction- The author must state they do not know the person (or group), they must state that it is fiction, and they must state that there is no money/profit made. Example Original fiction- The author must state it's a work of fiction, and include a resemblance clause. Original poetry- The author must state it's a work of poetry, and include a resemblance clause. Original non fiction- The author must state that it's a work of non fiction. They then must state that where possible, permission has been granted by the person (or people) involved in the story. Fiction based on Myths, Legends, and Fairy Tales- The original fiction disclaimer should be used for these stories. Example for the above Fiction based on books which are now public domain- The author needs to acknowledge the fandom in some fashion (whether inspired by or whatever), and add a resemblance clause, like what is required for original fiction. Blanket disclaimers in profile We don't accept them, as there are entirely too many categories throughout the archive, for it to be effective. You MUST attach a disclaimer to each and every story you add. I have included links to examples, so that you know exactly what we're looking for. The reason for the brevity, is the fact there are ONLY 240 characters available in the disclaimer field, and spaces do count as characters within the field. Verbose disclaimers within a chapter do NOT count as an author note, as that is not what they are. If you need to make a disclaimer which is more than 240 characters, in the disclaimer field, simply input -See full disclaimer below (oneshots) or See full disclaimer chapter 1 (multichapter). This TELLS us where to look.

  10. There are consequences to having a non disclaimed or improperly disclaimed story. When an improperly disclaimed fiction is found, the Admin will post a REVIEW stating the disclaimer is in violation, and what needs to be corrected. The user will have one week from the Review date to properly disclaim their work. After one week, if the fiction is still in violation, it will be HIDDEN. After a story is hidden, the user will have 30 days from the date the story is hidden, to properly disclaim the work and contact the Admin, requesting the fiction be returned to public view. If after 30 days, the fiction is still in violation, or the user has not contacted the Admin, it will be DELETED. Finally, yes, WE ALL DO realize that fanfiction by its NATURE is not for profit. However, if it's not stated, it's still not a proper disclaimer. So, whether some of you think it's obvious or not, it still MUST be stated. A blanket disclaimer in the user profile is not acceptable, it HAS to be attached to the story.
