The Obscene Publications Act rides again

Track this topic Print story Girls Aloud case heads for court - net holds its breath

The legal world is buzzing at the announcement last week of the prosecution of 35-year-old civil servant Darryn Walker for the online publication of material that Police and Crown Prosecution Service (CPS) believe to be obscene.

This is the first such prosecution for written material in nearly two decades – and a guilty verdict could have a serious and significant impact on the future regulation of the internet in the UK.

The case originated in summer 2007, when Mr Walker allegedly posted a work of fantasy – titled Girls (Scream) Aloud - about pop group Girls Aloud.

The story describes in detail the kidnap, rape, mutilation and murder of band members Cheryl Cole, Nadine Coyle, Sarah Harding, Nicola Roberts and Kimberley Walsh, and ends with the sale of various body parts on eBay.

The piece was brought to the attention of the Internet Watch Foundation, whose remit includes the monitoring of internet material deemed to be criminally obscene: they in turn handed details over to the Police.

The Met’s Obscene Publications Unit are currently handling the case, which is due to come before Newcastle Crown Court on 22 October. At that point, Mr Walker will have the opportunity to enter a plea and, if he opts for “not guilty” the court will set a date for a full trial.

Hard facts on this case are hard to come by, not least because it is now subject to the laws on contempt. There has been some speculation that the story was evidence of stalking intent – and also a degree of blurring between “blog” and “story”.

As far as the Reg is aware, the piece for which Mr Walker is to be prosecuted is story, rather than blog. Reports suggest it was published on “the Kristen archives”, which is itself hosted by the Alt Sex Stories Text Repository (asstr).

Internet veterans will be aware of the alt.sex hierarchy of discussion groups as forming part of usenet, one of the oldest surviving network comms systems still in use and pre-dating the world-wide web by over ten years. Asstr is effectively an archive of any and every story posted in alt.sex since its inception.

Material hosted on this site is subject to little moderation: content ranges from the mildly pornographic to the seriously extreme, and therefore does include subjects (rape, underage sex, bestiality) that much of the population finds disturbing or distasteful.

The true significance of this case – and the reason for our interest – is that it is the first prosecution under the Obscene Publications Act 1959 in respect of written content since 1991.

This Act is the yardstick by which obscenity is measured in the UK: it is an offence to publish material that tends to “deprave or corrupt” its audience.

Unfortunately, the Act has had a somewhat chequered history in respect of the written word. Its first major outing was in respect of Lady Chatterley’s Lover in 1960, which resulted in a resounding rebuff for the establishment view that promiscuity should be deemed obscene.

Initial success in prosecuting the publishers of the Oz Schoolkids issue in 1971 was followed by a reversal on appeal. In 1976, following the acquittal of the publishers of Inside Linda Lovelace, the Metropolitan Police pretty much abandoned prosecutions against books, believing that if Inside Linda Lovelace was not obscene, then nothing was.

The last such case was in 1991, when Manchester magistrate Derrick Fairclough ordered the seizure under section 3 of the OPA of David Britton’s Lord Horror. This would have allowed the book to be destroyed without jury trial. Again, the decision was overturned by the Court of Appeal.

The significance of this prosecution cannot therefore be understated. At present, the UK effectively has no sanction against written material, no matter how apparently obscene. This is not the case for pictorial material, which is regularly seized, prosecuted and in many cases deemed obscene.

Kirsty Brimelow, a barrister with Doughty Street Chambers, probably represents one strand of establishment thinking on this subject. Speaking to the Reg, she said: "There have been rumblings within the legal profession for some time over difficulties policing the internet. There is so much disgusting material that is easily accessible to the general public and can hardly be described as being in the public good.

"The legal system needs to tackle the internet and draw the line between unsavoury material and that which should be classified as criminal.

There have been other straws in the wind. During the consultation phase for the new extreme porn law, Kent Police opined that it did not go far enough and that it ought to include strictures on the possession of written material as well.

Reading between the lines, this feels like a very tentative “toe in the water” on the part of the Met. After investigating the material in question, they clearly believe that this may at last be enough for a successful prosecution - they put the file before the Crown Prosecution Service, who appear to agree.

The implication for UK surfers is immense. If another not guilty verdict is returned, then written material on the internet – as written material elsewhere – will return to its present near-privileged status. On the other hand, a guilty verdict could change much.

This is not just because certain categories of writing could in future be deemed obscene but, as the US Supreme Court is usually keen to point out, the fear of prosecution itself is likely to cause a major chilling effect. Individuals will not write in case they overstep the Law.

More on this later in the month. ®

I saw this on another story site, and the owner was very alarmed. I know that there are similar stories in the AFF, so you guys might want to do something...

  2. Written something for purely writing it "in that moment"?

When I think of fics like this, I think of movies such as The Terminal or Girl With a Pearl Earring. You meet characters (but don't know how they got where they are), things happen to the characters, and then the story is over. You see only what is happening to them in the particular stretch of time that the fic/movie is going on for.

I've written a few of these. Anyone else? If you have, have you ever gotten the "WTF is going on here?!" comments...

Like a fic can't be good without knowing the character's entire life story and reasoning behind every action. I always hand these over to friends (that I know are literate) and they get it just fine. It's a little demoralizing, to say the least...

I recently got into this style as I got into the fandom of an on-going anime series. I like the fact that it exercises my quick-writing skills, but I find that it also makes stories quickly obsolete...

  3. Hmm... I've never done rape or consensual BDSM in real life, yet I've received differing feedback on those kind of scenes. A reviewer once said that my rape scene is believable. Another said that my SM scene is unconvincing.

Maybe some things are harder to imagine or portray. I'd suggest some research (read, watch videos, observe the local scene).

  4. Hmm... what rewards me?

First... perhaps the feeling of having 'filled' some aspect of the character/storyline not explored by canon.

Another would be being able to write down some of my own fantasies. (I get this high too in discussing stories with other people).

Just like Streti, I enjoy reading my own stories again in the future, although it can be frustrating to be reminded that I haven't finished this or that story >.<

One thing I enjoy in developing stories is the research. I like my stories keeping with canon, so I enjoyed checking whether facts in my stories agree with what the fans know.

  5. How about each girl has a mental or physical flaw or a particular sexual hang-up... if you want to make it real challenging!

"Harem of the Damned" "Harem of the maimed" "Harem of the Psycho Killers"

Examples:One girl is missing a leg, another an arm, an eye, all Lost in battle because they are X military or black co-vert Ops, Spys... sick deadly chicks with an edge! :P

One girl doesn't like to kiss, but will do anything else sexual, and another is turned on by male bare feet...etc etc etc!

One will only have sex, if she defeated by physical force by either male or female

Look just because one is handicaped, mental or a little bite psycho, doesn't mean they can't be beautiful and kinky too!

Wouldn't you love to see a TV Reality show based on this premise :P Just Old Cal

Hmm, you didn't stray off-target that far. In this anime, the ladies can be described as "Harem of the Psycho Killers"! (and hot). The guy, on the other hand, was your average boring salaryman which by accident got marooned in that lawless place.

Would you be willing to explore this further?

Maybe a progression of women whose behavior, names, tattoos or costumes reflect the zodiac? I vaguely remember a comic where a supervillain sold his soul to have zodiac powers for a year so he could kill the hero. Archer, fish man, giant crab, i forget most of the details. After a few hours of chasing the hero around, the devil showed up and said, "That's a wrap." In using all 12 signs (in the chronological order no less), the devil counted it as a Zodiac Year. Time's up. Maybe your hero can't come home for a year, or has some other problem that will haunt him for a complete trip of the sun through the stations of the sky, like being chased by an assassin or having to survive without money or he was poisoned but cannot take the antidote until the year's up, but after sleeping with 13 women (Gemini Twins of course), he's survived a Zodiac Harem Year ?

I don't think there will be 12 of them, so this would be too much...

  6. It just hit. Sometimes after re-watching an old series, ideas arrive.

I've been thinking of writing a harem-type story (M/F+) since this morning after an all-night marathon of re-watching an anime series.

But I don't have a complete set of ideas, yet.

All I have is that the main character (the guy) gets chased around town by the main girl (tsundere-type) and he ends up bumping into the other female characters, which then would lead into sex scenes, but so far I haven't fleshed out the details.

    Any ideas? Feed me ideas!!!

    btw:

  7. Bukkake... I kinda like it, but it does get repetitive.

A bukkake scene I find memorable is in one japanese AV I saw, that involves a ganguro-gal... the contrast between heavy makeup and white sperm is interesting.

  8. Okay. So Code Geass enters season 2 with moar fanservice, especially in the form of Bunny Girl Kallen. My take on her situation is the following.

    Title: Bunny Girl

    Author: NinjaGaijin

    Rating: Adult+

Summary: Kallen Stadtfeld appeared as a bunny girl waitress on the first episode of R2. This story speculates about her days just before she and the Black Knights attempted to recover Lelouch’s memory as Zero.

    Fandom: Code Geass

    URL: http://anime.adult-fanfiction.org/story.php?no=600044009

    Featuring: Kallen

  9. So... anyone here watch Code Geass?

The series had just aired its 2nd season and it has lots of delectable female and male characters, prime fanfic fodder... so why haven't more people write in this fandom?

    Let's start the discussion.

  10. Two words I didn't see on the list:

Quim and cunny (popular in Victorian era porn/erotica). Cunt (overcame my aversion to that long ago, it's just a word) and pussy don't really bother me if they fit the overall tone of a story. Personally, I don't see how you can write any kind of anal sex scene without the use of rectum or anus at least once or twice.

    Interesting thought.

I like stories with a historical/fantasy setting, and I've always wondered which sexual terms would be anachronistic if used in such stories. Say, mentioning 'anus' in a story taking place in ancient China or the stone age. Wouldn't a Latin word feel out of place?

  11. if you are going for the humorous or erotic, I would say, have her be naked when she transforms back. However, if you want it to be more serious or credible, have her normal clothes transform into her fantasy outfit. This way, you don't have to bother with the clothes nearby scenario and when she changes back, she'll have the same outfit. That just makes more sense to me. That's how Sailor moon worked. Cardcaptor Sakura scenarios only work if your character has a sidekick to carry around her normal clothes and help her change when danger arises, like Tomoyo. Or, you can have an Ah My Goddess or Scar Tissue approach in which the character is not human and can transform her clothes to anything she wants by changing molecules using magic.

Thanks for the idea. In the story, the character is a normal female that discovers a device that can turn her into a sexier version of herself (makeover & clothes & mindset temporary change included). I'm leaning towards naked back-transformation with normal clothes discarded; that might also get rid of the problem of new clothes appearing out of nowhere; if they vanish with the back-transformation, it would make the story more interesting... she gets back to her old self, but naked and sore in the nether regions!

  12. hi guys and girls,

I'm currently writing a story in a fantasy setting, and soon I will hit a magical transformation scene (think Sailor Moon or Card Captor Sakura).

Now, I've been advised to leave the magical stuff magical, but somehow I'm not yet satisfied with magical transformation mechanics. The following questions might be silly...

If my character (a woman) was wearing her normal clothes when transforming into her alter-ego, with different clothes, then what should happen to her normal clothes? Should they vanish? Should they get taken off her but still existing nearby? (Something like throwing open a large robe to reveal clothes worn underneath) Should they be transformed into her new costume? How should I portray back-transformations (from alter-ego back to normal)? Would she return back in her normal clothes (which have vanished/dropped/transformed)? Or naked (with her normal clothes gone--"I lost my favourite skirt in the last transformation!")?

    (...do I seem incoherent?)

Anyway. I hope you peeps can give me some suggestions. Thanks in advance.

  13. I finally found something to write in this thread. It doesn't actually stop me from reading, but it does annoy me if I come across it.

"OH MY GOD!" and its variations, said while fucking.

Mentioning deity during intercourse, IMO, takes away the hotness. It gets worse if the deity got specified (I've seen the following in various fics: Jesus, Allah, Zeus, Kami-sama... but no one mentioned Cthulhu. Yet.)

I know (from Western porn) that this might be a correct portrayal of how you westerners fuck, but I just find it not sexy. For comparison, local people here grunt and moan and say stuff about pleasure and/or pain while fucking, but they never get the need to shout out to the supposed creator while having sex.
